Timothy H. David and John H. McElyea founded the law firm of Timothy H. David, P.A. in 1988 after meeting at a prominent Florida insurance defense firm. The two became frustrated defending big insurance companies against claims of the injured, and decided to start a firm that would uphold the rights of consumers. Florida native Timothy H. David earned his Bachelor of Science degree from the University of Central Florida in 1981. He attended Nova Law School in 1985, where he earned his Juris Doctor degree. He was admitted to the bar in 1986 (Florida and U.S. District Court, Middle District of Florida), and worked for a prominent insurance defense firm in central Florida until he and John H. McElyea opened their own personal injury practice in 1988.
The practice has since flourished, and Mr. David has established himself as a leader in his field. His is a member of the American Bar Association, the Orange County Bar Association, the Florida Bar, the Academy of Florida Trial Lawyers, and the Association of Trial Lawyers of America.
A native of Belle Glade, Florida, D. Paul McCaskill graduated magna cum laude from the University of Central Florida in 1983 with his Bachelor of Arts degree. He earned his Juris Doctor degree from Florida State University in 1986, and was admitted to the Florida bar in 1987. He is a member of the Order of the Barristers and the Florida State University Moot Court Team, where he received the Best Appellate Brief and Finalist Awards (1986) at the National Administrative Law Moot Court Competition. He served as Articles and Notes Editor of the Florida State University Law Review, and has authored several published articles including "The Driver's Right to Counsel Prior to Taking a Breathalyzer Test: What Process is Due?" (13 Florida State University Law Review, 1985) and "Plaintiffs Under Florida RICO Must Meet Traditional Equity Requirements When Seeking Temporary Injunctions to Safeguard Assets" (14 Florida State University Law Review 975, 1987).
Before joining our Florida firm as an accident attorney, Mr. McCaskill served as judicial clerk to the Honorable Douglass B. Shivers, First District Court of Appeals, Tallahassee from 1986 to 1988. He currently maintains membership in the Florida Bar Appellate Practice Section.
